2007 Senate Bill 5338: Addressing traffic infractions involving rental vehicles.

To amend provisions regarding parking citations and traffic infractions by rental car drivers. The bill would require private parking companies to mail rental car parking citations to the rental company within 30 days. The rental car company would be required to give the parking company the contact information of the customer who committed the infraction, or a statement and a police report showing the car was stolen. Rental companies may pay the fine in lieu of turning over the customer’s information.   Official Text and Analysis.

To add a process for relieving a rental car business of liability for certain parking infractions at private parking facilities that occur while the vehicle was being rented. Language is clarified requiring that when a rental car business claims that the business is unable to determine who was driving or renting the vehicle when the infraction occurred, the business must submit a filed police report indicating the vehicle was stolen.
