2013 House Bill 1001: Creating a beer and wine theater license

Creates a theater license to sell beer, including strong beer, or wine, or both, at retail, for consumption on theater premises. The annual fee for such a license will be four hundred dollars. The bill also provides that if the theater premises are frequented by minors, an alcohol control plan must be submitted at the time of application. The alcohol control plan must be approved by the board, and be prominently posted on the premises, prior to minors being allowed. (See also SB: 5111).   Official Text and Analysis.

Narrows the definition of "theater" to mean a place of business where motion pictures or other primarily nonparticipatory entertainment are shown; requires that all servers of beer and wine attend a mandatory alcohol server training program; subject to specified conditions, permits theater licensees that are nonprofits exempt from taxation under 26 U.S.C.501(c)(3) to enter into agreements with a liquor industry member for purposes of brand advertising at the theater and specifically provides that such an agreement is not a violation of the statutory prohibition preventing a liquor industry member from advancing to a retailer money or other valuable consideration.

Creates a theater license to sell beer, including strong beer, and wine, at retail for consumption on theater premises. The annual fee for such license is $400. No food requirements are specified. A Senate amendment specifies that only theaters with four or fewer screens are eligible for the license. "Theater" is defined as a place of business where motion pictures or other primarily non-participatory entertainment are shown.
