2011 Senate Bill 5140: Allowing the deportation of criminal alien offenders serving a sentence

To allow the deparmtment of corrections to deport illegal aliens who are serving a sentence, by repealing the rquirement that releases may occur only with the approval of the sentencing court and the prosecuting attorney of the county of conviction. The bill also replaces references to the “naturalization service” with “customs enforcement” agency. The bill would take effect immediately. (Companion: HB 1688).   Official Text and Analysis.

To provide that an arrest warrant for an alien offender who is transferred to ICE prior to the expiration of his or her term of confinement must remain in effect indefinitely.
