2011 House Bill 1028: Using state correctional facility populations to determine population thresholds for certain local government purposes

Allows for cities using the mayor-council form of government to include in population estimates the population of any state correctional facility located within the city. Cities with populations of less than five thousand who receive state funds for maintenance of streets and sidewalks to include in population estimates the population of any state correctional facility located within the city. To clarify that, when calculating population for purposes of determining how many city council members are required or eligibility for funding from the Small City Pavement and Sidewalk Account, certain local governments have the discretion to count the population of any state correctional facility located within the city.
