2013 House Bill 1568: Concerning the business licensing service program administered by the department of revenue

Makes technical changes in current law to use consistent language in provisions related to business licensing for many types of businesses. This act makes information related to getting a business license subject to public disclosure. This act also authorizes the Department of Revenue to require annual renewal of trade names, and cancel trade names in certain circumstances.   Official Text and Analysis.

Requires all cities that impose a business and occupation tax to have their general business licenses issued and renewed, if renewal is applicable, through the state's BLS or a city-developed portal by July 1, 2016. Cities that do not impose a business and occupation tax must have their general business licenses issued and renewed, if renewal is applicable, through the state's BLS or a city-developed portal by January 1, 2019.

Makes many technical changes to business licensing and trade name laws. In addition, more specificity is provided in state law regarding the renewal and cancelation of trade names. Trade name renewal cannot occur more often than annually. The Department of Revenue (DOR) can cancel the trade name of any person whose business license account becomes inactive in the DOR business license system or at the request of the person, to whom the trade name is registered. The DOR is required to make reasonable effort to provide notice to a person prior to cancelation of a trade name unless it is the person requesting the cancelation of a trade name. The definition of "person" is expanded to ensure confidential licensing information is not disclosed by the DOR. References of the master license service in statute are changed to the business license service. Obsolete provisions of the law are eliminated.
