2011 House Bill 1648: Adding certain requirements to provisions relating to DUIs

Modifies certain provisions related to driving or being in physical control of a vehicle while under the influence of intoxicating liquor or any drug. This act requires day-for-day credit toward the total amount of a driver’s restriction for the days the driver maintained an ignition lock device on his or her vehicle. This act adds to current law a specific limit for THC (marijuana) in a person’s blood to support a DUI charge, but prohibits that blood level from being used to charge a person with possession of marijuana. This act requires a person convicted of reckless (when the original charge was DUI) or negligent driving to install an ignition interlock device on all vehicles operated by the person. This act prohibits a person from participating in a deferred prosecution program for a DUI-related offense more than once and requires a person participating in such a program to install an ignition interlocking device on vehicles he or she operates.   Official Text and Analysis.
