2011 House Bill 1635: Concerning the administration of exams and renewals for drivers' licenses

Allows driver training schools to administer the portions of the driver’s examination related to traffic laws and the applicant's knowledge of traffic laws and ability to safely operate a motor vehicle. Driver training schools may not charge an applicant more than twenty-five dollars to administer the driving portion of the examination and may not charge an applicant more than ten dollars to administer the knowledge portion of the examination. This act increases the driver’s license renewal fee from twenty-five to thirty dollars. This act allows the Department of Licensing to waive five dollars of the renewal fee if a person renews his or her driver's license through the mail or through online services. This act also appropriates two hundred thousand dollars for 2011-13 biennium for the Department to promote and develop its online services.   Official Text and Analysis.

Adds an intent section; adds school districts that offer a traffic safety education program under the supervision of the Office of Superintendant of Public Instruction to entities authorized to administer both portions of the driver's license examination; allows the DOL to authorize motorcycle training schools that are under contract with the DOL to administer the motorcycle endorsement examination; removes the cap on fees that may be charged by driver training schools to administer the driver's license examination, and requires the DOL to limit, through rule, the fee that may be charged by driver training schools; requires the DOL to form an advisory committee to facilitate communication in connection with the transition to driver training schools and school districts administering the driver's license examination, provides requirements about members of the committee, and gives the committee a reporting requirement; limits liability for the state, other government entities, and driver training schools for any act or omission done in connection with administering the driver license examination; increases the original fee and the renewal fee for a CDL endorsement, an identicard, and a motorcycle endorsement, and increases the fee for an original driver's license; extends the expiration period for a CDL, an identicard, and a motorcycle endorsement; allows the DOL, until July 1, 2020, to issue or renew driver's licenses and identicards for a period other than six years, but not exceeding six years, to evenly distribute the yearly renewal rate; and, adds to the requirement on the DOL to adopt rules to oversee the driver training schools' administration of the driver's license examinations.

To offer a striking amendment that changes the intent section language to say that the Legislature intends the Department of Licensing to authorize commercial driver training schools and school districts that offer traffic safety education programs to provide driver licensing examinations and requires the Superintendent of Public Instruction to consult with school districts that offer a traffic safety education program when the Superintendent works with the Department of Licensing to develop standards and requirements for administering the driver licensing examination, and requires that the standards and requirements that are developed be comparable to those required of commercial driver training schools, among other things.

Increases fees for a commercial driver endorsement, an identicard, a motorcycle endorsement, and a driver's license, and extends the expiration period for each of the licenses proportionately.

To add clarifying language directing that the agreements between DOL and school districts must take into account the unique nature of school district facilities and school hours. The advisory committee requirement is replaced with language requiring DOL to include a representative from each stakeholder group in any communications regarding the transition to school districts and driver training schools administering the exams.
