2011 House Bill 1360: Providing for health care liability reform

Modifies current law regarding health care liability. This act clarifies the class of those eligible to sue certain providers. This act expands the criteria for recovery of noneconomic damages. This act clarifies the statute of limitation for certain legal claims. This act also provides for a cap on noneconomic damages if the Supreme Court determines the cap is constitutional or if a constitutional amendment for a cap is passed. This act makes provisions for awarding reasonable attorneys fees to defendants when cases are dismissed by the court. This act also provides for awarding periodic payment of future damages, allowing for payments to be made over a period of time in lieu of a lump sum payment. This act makes further provisions for arbitration, early settlement offers, and business and occupation tax credits for physicians who serve uninsured patients.
