2011 House Bill 1046: Regulating vehicle and vessel quick titles and service fees

To regulate quick title applications and service fees for vehicles and vessels. The bill sets forth the form and content of information required in an application, such as name of the owner and description of the vehicle or vessel, and imposes a fee of twenty-five dollars to be distributed to the motor vehicle fund. To establilsh the definition of a quick title as a certificate of ownership printed at the time of application. Sets a fee for a vehicle and vessel quick title of $75. Allows subagents after January 1, 2013, to provide quick title services for an additional fee of $25 in a county in which the county auditor or agent also offers the service and the subagent is selected by the county auditor or agent.

To define a quick title as a certificate of ownership printed at the time of application. County auditors or DOL agents are authorized to process quick titles. A $25 fee is charged to process a quick title. When the transaction is performed by the county auditor, subagent, or DOL's agent, $12.50 of the fee is deposited into the Motor Vehicle Fund for a vehicle, or the General Fund for a vessel, and the balance is retained by the county treasurer or DOL's agent.

Senate receded from amendments, but added a new stiking amendment. The amendment sets the fee for a quick title at $50 and clarifies that if a county auditor, other agent, or subagent receives the fee, half must go into the Motor Vehicle Account and the other half is retained by the county auditor or other agent. If DOL receives the fee, the entire amount must be deposited into the Motor Vehicle Account. The requirement that an implementation report be submitted to the Legislature is removed.
