2007 Senate Bill 5391: Modifying photo enforcement of traffic infraction provisions.

To modify the provisions on photo enforcement procedures. The bill would require that traffic infractions issued through photo enforcement, to be handled in the same way as parking infractions. The bill also requires the amount of the fine to be $40, plus three times the amount of a toll evaded, if applicable. If the defendant can prove the toll was paid, the court shall dismiss the ticket, but may also impose a $20 administrative fee. See companion HB 1373.   Official Text and Analysis.

To change the photo enforcement system statute for toll violations to conform with the administrative provisions found in ESSB 5060, enacted in 2005. Toll violations detected through the use of photo enforcement systems must be processed in the same manner as parking infractions and the penalty is set at $40 plus three times the toll. The $40 penalty remains with the local jurisdiction processing the violation, and the "three times the toll" penalty must be deposited into the statewide account in which tolls are deposited for the respective tolling facility.
