2007 Senate Bill 5352: Specifying the burden of proof in disciplinary actions for health professionals.

To specify the burden of proof in all disciplinary actions for health care professionals is a preponderance of evidence. The legislature finds that the preponderance standard as currently adopted by the Department of Health by rule for health professionals does not violate principles of due process or equal protection.   Official Text and Analysis.

To change the title of the bill to "Disciplinary Actions Involving Health Professionals" All references to the standard of proof in disciplinary proceedings are removed. Clear procedures are established with regard to the use of expert witnesses in disciplinary hearings for health professionals.
