2007 House Bill 1669: Concerning the district and municipal court's probation and supervision services

To provide immunity for court officials administering probation services and related services from civil damages. The bill exempts state court officers, employees, agents, and volunteers who administer pre-conviction or post-conviction services from civil liability damages resulting from any act or omission in the administration of these services.   Official Text and Analysis.

Substitute offered to the House Judiciary Committee on February 27, 2007
To modify the original bill which limits immunity for damages arising from "any act or omission in the provision of probation, supervision, or monitoring services." The substitute bill applies to damages arising from "inadequate supervision or monitoring." The original bill provided a clear, cogent, and convincing evidence standard of proof in actions alleging liability based on misdemeanor probation or supervision services. In addition, the original bill did not include the statement that the act does not affect judicial immunity.
