Clarifies that levels and flows may limit groundwater withdrawals from permit-exempt wells only if Ecology demonstrates that the particular groundwater withdrawal from the specific permitexempt well at issue, by itself and not when considered as part of the aggregate of groundwater withdrawals, will in fact cause impairment to levels and flows. Changes the title from “An ACT Relating to existing lots and the Skagit instream flow rule” to “An ACT Relating to the effects of instream flow rules on water use”.

Provides that within one year of the effective date of section 3 of theact, the department of ecology must review the Skagit river instreamflow rule, and if necessary, amend it, to set aside sufficient waterfor year-round residential use.

Requires the department of ecology to review the Skagit river basin instream resources protection program rule to determine whether the rule has set aside sufficient water reservations to satisfy year-round human domestic needs in designated water resource inventory areas 3 and 4.
