2009 House Bill 1234: Making abandonment of a dependent a crime

To make it a fourth degree misdemeanor for the abandonment of a child in the custody or a parent or guardian. This act does not apply to the transfer of a new born by a parent to an authorized person or party. (See also Companion SB 5454).   Official Text and Analysis.

Substitute offered in the House on February 17, 2009
To limits the application of the crime to circumstances involving children under the age of 6 years, when the dependent person at issue is a child. The substitute also modifies the crime to circumstances in which abandonment creates an imminent and substantial risk of bodily harm to the child or other dependent person or causes bodily harm or extreme emotional distress manifested by more than transient physical symptoms.
