Introduced by Rep. Eileen Cody, (D-West Seattle) (D) on January 15, 2009, to prohibit the sale and delivery of tobacco products that are purchased through the mail or internet. Wholesale operations are exempted in this act. The penalty for participating in the purchase of tobacco products through the mail is no more than five years in prison or a fine of no more than five thousand dollars. (See also Companion SB 5340).

Substitute offered in the House on February 13, 2009, to apply the shipping restriction to all tobacco products except for cigars, adds the shipping restriction to the chapter addressing access of minors to tobacco (instead of creating a new chapter in the code), uses the term "Internet" to describe computer, telephonic, or other electronic networks, changes the criminal penalty to an unranked class C felony, adds a requirement for civil penalties to be recovered by the Attorney General in a civil action in superior court and deletes definitions that are used only in the repealed "delivery sales" law. The substitute passed in the House by voice vote on February 13, 2009.
