Phil Rockefeller, (D-Kitsap County) (D) on January 26, 2009, provides that if an adjudication is needed for effective water management,, the department, of natural resources in consultation with the administrative office of the courts, will determine whether sufficient resources are available to conduct an adjudication before proceeding. Substitute offered in the Senate on February 25, 2009, requires a water right claimant to petition Ecology prior to Ecology commencing a limited adjudication. Adds that prior to filing a limited adjudication, Ecology must notify and consult affected state agencies, local governments, and Indian tribes; publish notice of its intent to file a limited adjudication; and
post notice of the intent to file a limited adjudication on its website. The substitute passed in the Senate by voice vote on February 25, 2009.
