Introduced by Rep. Christine Rolfes, (D-Bainbridge Island) (D) on January 27, 2009, authorizes local jurisdictions to prohibit the use of solid fuel burning devices, except fireplaces, and wood stoves in areas designated nonattainment for fine particulate matter by the United States environmental protection agency. Substitute offered in the House on February 19, 2009, to allow the local air authority or the DOE to prohibit the use of noncertified solid fuel burning devices to maintain attainment as well as to achieve attainment with federal air quality standards.
