2008 Senate Bill 6708 (Eliminating the partial relinquishment of water rights)

  • Introduced by Sen. Bob Morton, (R-Orient) on January 22, 2008, provides that a person shall not be deemed to have failed to beneficially use water rights if the person has continued to use at least a portion of such water rights (see companion HB 3072) .

This is Bill is especially important in cases when, during drought, there is insufficient water to meet the surface water right. Also, as in the case of Rosa District vs WA State, 'water spreading' and crop rotations as well as irrigated field rotations can necessitate use of less water in some years.

Such a Bill may also help avoid future over-allocation.
