2006 Senate Bill 6169: Allowing homeowners associations to remove discriminatory language from covenants

To allow homeowners associations to remove discriminatory language and restrictions from covenants and governing documents. "Discriminatory language" refers to restrictions based on race, creed, color, sex, or national origin; families with children status; individuals with any sensory, mental, or physical disability; or individuals who use a trained dog guide or service animal because they are blind or deaf or have a physical disability. Amendment offered by Sen. Jeanne Kohl-Welles (Seattle) (D) on February 8, 2006
To provide that a homeowners' association board is required to amend, within a reasonable time, their governing documents upon receiving a written request from any association member. It clarifies that a homeowner, occupant, or tenant does not have a duty to amend, and is not liable for failure to amend, their governing documents under this act. It is further clarified that an association board only has a duty to amend, or is liable for failure to amend, in the event that the board fails to act within a reasonable time after receiving a written request to amend the governing documents for the purpose of removing restrictive covenants, as provided in this act.
